The Supreme Court dismissed the appeal against the High Court's order which set aside the Labour Court's dismissal of the respondents' applications under Section 33-C(2) of the Industrial Disputes Act, 1947 for overtime wages. The Court held that the appeal was not maintainable due to the respondents no longer being in service, the small amount involved, the long elapsed time since the claims arose (1986-1990), and the fact that the amounts had already been paid. The Court found no merit in the legal issues raised by the appellants regarding the interpretation of the Bombay Shops and Establishment Act, 1948 and the Factories Act, 1948.
