The Supreme Court allowed I.A. No. 126775 of 2017, condoning the delay in filing the application for restoration and recalling the order dated 03.06.2016 that dismissed the appeal. The Court found no merit in the appeal against the concurrent findings of fact by the first appellate court and the High Court, which established that the appellants had encroached upon the plaintiffs' land without proper acquisition. The Court upheld the findings regarding the lawful demarcation of the suit land by the Tehsildar in the presence of the Municipal Council's representative.
