The Supreme Court overruled its previous judgment in Va Tech Escher Wyass Flovel Ltd. v. MPSE Board & Another, (2011) 13 SCC 261, establishing that the jurisdiction to resolve disputes under the M.P. Madhyastham Adhikaran Adhiniyam, 1983 lies with the M.P. Arbitration Tribunal. The Court set aside the impugned order under Section 11 of the Arbitration and Conciliation Act, 1996, remanding the matter for merits consideration by the Tribunal. The appeals were disposed of with directions for parties to appear before the Tribunal on 9th July, 2018.
