Judgment text excerpt

The Supreme Court addressed the issue of property rights under the Uttar Pradesh Zamindari Abolition and Land Reforms Act, 1950 and the Uttar Pradesh Sugar Undertakings (Acquisition) Act, 1971. The Court held that the Plaintiffs retained their rights to lease the land despite the Defendant-Corporation's claims of ownership, as the land was declared non-agricultural under Section 143 of the 1950 Act. The Court reversed the High Court's decision, reinstating the eviction order against the Defendant-Corporation and affirming the Plaintiffs' entitlement to arrears of rent.
