Judgment text excerpt

The Supreme Court held that the marriage between appellant No. 1 and Thushara was invalid as appellant No. 1 was not of marriageable age on the date of marriage, violating the provisions of the Prohibition of Child Marriage Act, 2006. The Court emphasized that the age of marriage for males is 21 years, and since appellant No. 1 was born on 30.05.1997, he was only 19 years old at the time of marriage on 12.04.2017. Consequently, the High Court's order to entrust custody of Thushara to her father was upheld, reinforcing the legal principle that a marriage is void if one party is below the legal age of marriage.
