Judgment text excerpt
The Supreme Court addressed the issue of backwages for police constables whose termination was deemed unlawful by the High Court. The Court held that while the constables are entitled to continuity of service from the date of termination to reinstatement, they are not entitled to backwages from the date of termination until the judgment date of the learned Single Judge. However, the Court tentatively decided that they should receive equitable relief in backwages from 8.12.2008 to 27.05.2009, limited to those before the Court as petitioners or impleaders.
