The Supreme Court ruled that Section 5 of the Limitation Act, 1963 cannot be invoked to condone the 30-day limitation period prescribed under Section 30(1) of the Recovery of Debts and Bankruptcy Act, 1993 for appeals against orders of the Recovery Officer. The Court held that the RDB Act is a complete code regarding recovery procedures, and the express provisions of the Act do not allow for the extension of the limitation period. Consequently, the appeals were dismissed as time-barred.
