The Supreme Court ruled that the Appellants, Dr. Shobha Nelson and Dr. Sudhir Kumar Nelson, were entitled to be deemed in service from 13.08.1991, as the State of Madhya Pradesh had initially permitted their foreign assignment and later failed to comply with the Administrative Tribunal's orders. The Court emphasized that the delay in accepting their joining report was unjustified, and thus, the Appellants were entitled to full salary and benefits from the date of their joining report. The Court set aside the High Court's decision that limited their entitlement to 20 percent of their salary from 03.01.1996, thereby restoring their full rights as employees of the State.
