The Supreme Court addressed the issue of backwages for police constables in Uttar Pradesh whose termination was deemed unlawful. The Court held that while the constables are entitled to continuity of service from the date of termination to reinstatement, they are not entitled to backwages from the date of termination until the judgment date of the learned Single Judge, but may receive equitable relief for the period from the judgment date (8.12.2008) to reinstatement (27.05.2009). The Court emphasized that this relief applies only to the petitioners and impleaders before it.
