Judgment text excerpt

The Supreme Court held that the conviction of the appellant under Section 307 IPC was not sustainable as the prosecution failed to prove the intent to cause death. The Court found that the injury inflicted was not on a vital part of the body and that the appellant acted without premeditation. Consequently, the Court convicted the appellant under Section 324 IPC instead and reduced the sentence to the period already undergone, allowing the appeal.
