Judgment text excerpt

The Supreme Court examined the applicability of Section 24(1)(b) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, in relation to land acquisition proceedings initiated under the Land Acquisition Act, 1894. The Court held that since the award was passed within five years prior to the commencement of the Act of 2013, the provisions of Section 24(1)(b) apply, and thus the proceedings do not lapse, rejecting the High Court's interpretation that the proviso to Section 24(2) is applicable. Consequently, the appeals by the Delhi Metro Rail Corporation Ltd. were allowed, affirming that compensation is not payable under the Act of 2013.
