The Supreme Court dismissed the appeal filed by the tenants against the eviction order, holding that the eviction petition was maintainable at the time of filing despite the subsequent amendment to Section 2(7) of the Karnataka Rent Control Act, 1961. The Court reaffirmed the principle established in R. Kapilnath v. Krishna that pending actions are not affected by subsequent amendments. The appellants were granted time until 31.03.2018 to vacate the premises, contingent upon filing an undertaking.
