Judgment text excerpt

The Supreme Court upheld the High Court's conclusion that the proceedings for land acquisition have lapsed due to non-payment of compensation to the landowners, thus dismissing the appeal. The Court granted the appellant a period of six months to initiate fresh acquisition proceedings under Section 24(2) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. It was clarified that if no fresh proceedings are initiated within one year, the appellant must return possession of the land to the original owners.
