The Supreme Court upheld the decision of the Punjab and Haryana High Court, affirming that the dismissal of Dharam Singh, a JBT teacher, was unjustified as his conviction under Section 304 Part-II IPC was not for an offence involving moral turpitude after his co-accused were acquitted of similar charges. The Court noted that the offence under Section 323 IPC did not fall under the category of moral turpitude as per the State's instructions dated 26.03.1975. Consequently, the Court ruled that the respondent is entitled to all consequential benefits due to her deceased husband.
