The Supreme Court held that under Section 24(2) of The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, the proceedings for land acquisition lapsed as no compensation was paid to the appellants despite the award being passed on 05.02.1988. The Court clarified that mere deposit of compensation in treasury does not prevent lapse unless it is actually paid to the landowners, as established in Pune Municipal Corporation & Ors. Vs. Harakchand Misirimal Solanki & Ors. The respondents were granted one year to exercise their rights under Section 24(2).
