The Supreme Court upheld the validity of the Will dated 27.9.1968 executed by Palaniappa Chettiar and his wife, Rangammal, establishing it as a mutual and irrevocable Will that created a Trust for charitable purposes. The Court found that the subsequent Will dated 27.11.1980, claimed by defendants 4 and 5, was not executed in a sound state of mind and did not revoke the earlier Will. The judgment of the Madras High Court was set aside, affirming the original suit's claim that the management of the Trust could not be altered by the later Will.
