The Supreme Court overturned the Allahabad High Court's judgment which had set aside the eviction order against the tenant under the U.P. Urban Building (Regulation of Letting, Rent and Eviction) Act, 1972. The Court held that the tenant was indeed in arrears of rent and had sublet the premises, thus violating the tenancy agreement. The Court reinstated the Trial Court's decree for eviction and payment of rent and damages, affirming the application of Section 20(4) of the Act 1972.
