The Supreme Court held that in the absence of specific rules governing the selection process for the post of Deputy Surveyor, executive instructions under Article 162 of the Constitution can validly prescribe the procedure, including a physical endurance test. The Court found that since all candidates participated in the selection process without objection, they could not later challenge the validity of the procedure. Consequently, the appeals were dismissed as lacking merit.
