The Supreme Court upheld the High Court's decision that M/s. Haffkine Bio-Pharmaceutical Corporation Ltd. violated Central Vigilance Commission guidelines by not opening the tender of M/s. Bionet Asia Co. Ltd. in the presence of M/s. Nirlac Chemicals, thereby rejecting Nirlac's bid unfairly. The Court affirmed that Nirlac met all tender conditions and quashed the tender award in favor of Bionet. Consequently, the Court directed Haffkine to reconsider Nirlac's bid in compliance with the guidelines.
