The Supreme Court held that the High Court's order granting bail to the respondents under the NDPS Act was flawed as it did not consider the mandatory requirements of Section 37, which stipulates that bail can only be granted if the Public Prosecutor is given an opportunity to oppose and the court is satisfied that the accused is not guilty and unlikely to commit further offences. The Court emphasized that these conditions are essential when the accused is charged with offences involving commercial quantity of narcotics. Consequently, the Supreme Court set aside the bail order and directed the High Court to reconsider the application in light of Section 37 of the NDPS Act.
