HARYANA URBAN DEV. AUTHORITY vs ORCHID INFRASTRUCTURE DEVELOPERS P.LTD.

The Supreme Court allowed the appeal by Haryana Urban Development Authority, setting aside the High Court's judgment which had restored the Civil Judge's decree in favor of Orchid Infrastructure Developers. The Court held that the auction process was valid and the rejection of the highest bid was justified as the Presiding Officer had the authority to withdraw properties from auction without assigning reasons. The Court imposed costs of Rs. 5 lakhs on the plaintiff to be deposited in specified welfare funds, reinforcing the principle of judicial discretion in auction matters.
