The Supreme Court addressed the arbitration agreement between the petitioner, an Austrian company, and the respondent, Delhi Metro Rail Corporation Ltd., under Section 11(6) and Section 11(8) of the Arbitration and Conciliation Act, 1996. The Court held that the panel of arbitrators proposed by the respondent, consisting of serving or retired engineers, does not meet the independence criteria established by the amended Section 12 of the Act. Consequently, the Court appointed a sole arbitrator to adjudicate the disputes arising from the contract dated August 12, 2013.
