The Supreme Court held that under the Statement of Guidelines for Remission of Demurrage Charges, 1992, the petitioner is entitled to remission of demurrage charges for the period during which the goods were detained by Customs for ITC formalities. The Court clarified that the remission applies from the date of application for amendment of the Import General Manifest (IGM) and not from the date of noting. The Court ruled in favor of the petitioner, allowing the appeal against the Port of Bombay's demand for demurrage charges amounting to Rs.1,91,14,798.
