The Supreme Court held that the Modified Assured Career Progression (MACP) benefits are applicable from 01.01.2006, as per Clause (i) of the Government Resolution accepting the 6th Central Pay Commission's recommendations. The Court affirmed the Armed Forces Tribunal's decision that ACP is part of the pay structure affecting both pay and pension, thus entitling personnel below officer rank who retired before 31.08.2008 to MACP benefits. The Court dismissed the Union of India's contention that MACP was only applicable from 01.09.2008.
