The Supreme Court upheld the order allowing W.P. (M/S) No. 1209 of 2002, confirming that the Respondent is entitled to a 1/3rd share in the suit lands as co-bhumidar, based on the decree in Revenue Suit No. 22/15 of 1987-88 under Section 229(B) of the U.P. Zamindari Abolition and Land Reforms Act. The Court found that the previous determination of a 1/10th share was perverse and did not consider the finality of the earlier decree. The appeals by the Appellants were dismissed, affirming the Respondent's rights to the land.
