The Supreme Court examined the applicability of Section 3(1) of the Employees’ Compensation Act, 1923, which stipulates that an employer is liable for compensation if an employee suffers an accident arising out of and in the course of employment. The Court upheld the High Court's decision that the accident involving the deceased, who was returning from a work-related task, did not arise out of and in the course of employment, thus affirming the dismissal of the claim for compensation. The Court concluded that the circumstances of the accident did not meet the statutory requirements for employer liability under the Act.
