Judgment text excerpt

The Supreme Court upheld the validity of the 'Demobilized Armed Forces Personnel (Reservation of Vacancies in the Himachal Pradesh State Non-Technical Services) Rules, 1972', which provide for the reservation of vacancies for Released Armed Forces Personnel in non-technical services and allow counting of military service for seniority and pay fixation. The Court ruled that these provisions are constitutionally valid under Article 309 of the Constitution of India, affirming the benefits conferred to the appellants who were appointed as Assistant District Attorneys. The appeals were dismissed, thereby maintaining the application of the 1972 Rules.
