The Supreme Court upheld the order dated 17th March 1977 passed by the Defence Estate Officer under Section 5(1) of the Public Premises (Eviction of Unauthorized Occupants) Act, 1971, confirming the eviction of the appellants from the disputed land. The Court found that the appellants were in unauthorized occupation and that the proceedings initiated were valid. The dismissal of Suit No.1 of 1974-75 under Section 180 of the U.P. Tenancy Act was also noted, reinforcing the legality of the eviction order.
