The Supreme Court held that the Appellants, children of deceased government employees, are entitled to appointment in Class III posts under compassionate appointment guidelines, as established in Vishwanath Pandey v. State of Bihar (2013) 10 SCC 545. The Court found that the prior ban on appointments was lifted, and the District Compassionate Committee had recommended their appointment, which was not properly addressed by the State. The Court reversed the High Court's decision and directed the State to appoint the Appellants in regular pay scales as Assistant Teachers.
