The Supreme Court upheld the Bombay High Court's decision that the GYT-TPL Joint Venture was eligible to bid for a tender by the Nagpur Metro Rail Corporation, interpreting Clause 4.2(a) of the tender documents. The Court found that the Pearl River Delta Intercity High Speed Railway Project, executed by GYT-TPL JV, constituted 'metro civil construction work' despite being an inter-city project, as it involved the construction of a viaduct exceeding 5 km. The Court ruled that the disqualification by NMRCL was unjustified, thereby allowing the JV to participate in the bidding process.
