Judgment text excerpt

The Supreme Court addressed the authority of the State of Bihar to provide for reservation in judicial services under Article 16(4) of the Constitution. The Court held that while the Bihar Reservation of Vacancies in Posts and Services Act, 1991, intended to extend reservation to judicial services, such application would be unconstitutional as it conflicts with the provisions of Articles 233 and 234 regarding the appointment of judicial officers. Consequently, the Court ruled that the Act cannot govern the recruitment of judicial officers, thereby upholding the constitutional framework for judicial appointments.
