Judgment text excerpt

The Supreme Court upheld the High Court's decision that the amount receivable under the Haryana Compassionate Assistance to the Dependents of the Deceased Government Employees Rules, 2006, cannot be deducted from the compensation awarded by the Motor Accident Claims Tribunal under Section 166 of the Motor Vehicles Act, 1988. The Court emphasized that such deductions would undermine the purpose of providing adequate compensation to the dependents of deceased victims of motor accidents. The appeal by Reliance General Insurance Co. Ltd. was dismissed, affirming the High Court's enhanced compensation amount of Rs. 89,24,604/-.
