The Supreme Court held that under Section 7L(4) of the Employees Provident Funds and Miscellaneous Provisions Act, 1952, once remedies under the Act are exhausted, the Civil Court is barred from entertaining the matter. The Court clarified that while considering an application under Order VII, Rule 11 CPC, the Civil Court must only examine the plaint and not the written statement. The appeal was dismissed, but the appellants were allowed to raise a preliminary issue regarding the maintainability of the suit before the trial court.
