Judgment text excerpt

The Supreme Court upheld the decision of the Prescribed Authority under Section 21(1)(a) of the Uttar Pradesh Urban Buildings (Regulation of Letting, Rent and Eviction) Act, 1972, affirming the bona fide requirement of the landlady for Shop No. 6 to expand her daughter's medical clinic. The Court found that the landlady's need was genuine and that the tenant had alternative shops available, thus causing no hardship to him. The High Court's order setting aside the Prescribed Authority's decision was reversed, and the tenant was directed to vacate the premises.
