The Supreme Court upheld the Bombay High Court's decision that M/s. Guangdong Yuantian Engineering Company and M/s. TATA Projects Limited, as a Joint Venture, were eligible to bid for a tender by the Nagpur Metro Rail Corporation. The Court found that the Pearl River Delta intercity high speed railway project met the requirements of 'metro civil construction work' as stipulated in Clause 4.2 (a) of the tender documents, despite NMRCL's claim to the contrary. The judgment clarified that the experience in constructing a viaduct for a high-speed railway qualifies as relevant experience for metro projects.
