Judgment text excerpt

The Supreme Court held that the Sub-Registrar had no authority to register the Extinguishment Deed dated 9th August 2001, rendering it void ab initio, along with subsequent deeds dated 21st April 2004 and 11th July 2006. The Court emphasized that the High Court should have declared the registration void and set aside the orders of the Sub-Registrar and Inspector General. The appeal was allowed, and the respondents were directed to pay compensation of Rs. 10 Lakh to the appellant under Section 64 of the Madhya Pradesh Cooperative Societies Act, 1960.
