The Supreme Court addressed the implications of a transfer of land after the Section 4(1) Notification under The Land Acquisition Act, 1894, but before the Section 6(1) Declaration. The Court dismissed the appeal, allowing the appellant one year to initiate fresh acquisition proceedings under Section 24(2) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. It was clarified that if no fresh proceedings are initiated within this period, the appellant must return possession of the land to the owner.
