NOIDA TOLL BRIDGE COMPANY LTD. vs FEDERATION OF NOIDA RESIDENTS WELFARE ASSOCIATION AND ORS

The Supreme Court addressed the appeal by the NOIDA Toll Bridge Company Limited (NTBCL) against the Allahabad High Court's judgment which invalidated Articles 13 and 14 of the Concession Agreement dated 12.11.1997, thereby prohibiting NTBCL from collecting tolls on the DND Flyway. The Court held that the provisions of the Concession Agreement were valid and enforceable under the framework of the Public Private Partnership model, emphasizing the legality of toll collection as per the agreement. Consequently, the Supreme Court set aside the High Court's ruling, allowing NTBCL to continue toll collection.
