GHANSHYAM SUKHDEO GAIKWAD AND ORS vs BAJAJ AUTO LTD. .

The Supreme Court upheld the decision of the High Court which dismissed the writ petition filed by the appellants and allowed the writ petition filed by the Management, affirming that the retrenchment of the appellants was valid. The Court noted that the appellants had been receiving regular wages since 2002 but had not been working since April 2003. To advance the interest of justice, the Court ordered the Management to pay each appellant a lump sum of Rs. 10 Lakhs as settlement of all dues, to be paid within six weeks.
