The Supreme Court held that the land acquisition proceedings initiated under Section 4 of the Land Acquisition Act, 1894, have lapsed due to the declaration made for two of the three co-owners. The Court clarified that mere non-payment of compensation does not lead to lapse under Section 24(2) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. Consequently, the appeal was allowed, and the acquisition proceedings were set aside.
