The Supreme Court held that the order dated 12.09.2014 by the Tamil Nadu Government was not in compliance with its earlier judgment dated 07.02.2013 in SLP (C) 19016 of 2008, leading to its annulment. The Court directed the Principal Secretary to issue a fresh order in compliance and mandated the distribution of benefits from the new order dated 06.05.2016 within six weeks. The Court further stipulated that failure to comply would result in interest at 18% from the date of superannuation, with personal liability for responsible officers.
