The Supreme Court, in exercising its jurisdiction under Section 11(6) of the Arbitration and Conciliation Act, 1996, appointed Hon’ble Mr. Justice H.S. Bedi as the sole Arbitrator due to the respondent's failure to appoint an arbitrator as per the arbitration clause in the Engagement Letter dated 24th October 2013. The Court held that in the absence of a counter from the respondent, the petitioner's assertions must be accepted as correct for the purpose of referring the matter to arbitration. The Court clarified that it has not expressed any opinion on the merits of the case, leaving that for the Arbitrator to decide.
