The Supreme Court addressed appeals under Section 125 of the Electricity Act, 2003, concerning the determination of the date of commercial operation (COD) for a transmission line. The Court held that a transmission line charged without necessary switchgear and protection systems could not be commissioned for raising transmission charges, as per the second Proviso to clause (c) of Regulation 2 of the Central Electricity Regulatory Commission (Terms & Conditions of Tariff) Regulations, 2009. The Court upheld the Tribunal's decision to remand the matter back to the Central Electricity Regulatory Commission for redetermination of COD.
