The Supreme Court ruled that the provisions of the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995, particularly Section 32 and Section 33, mandate the reservation of at least three percent of identified posts for persons with disabilities (PWD) in Prasar Bharati Corporation. The Court held that the impugned office memoranda, which limited reservation to certain groups and modes of recruitment, were inconsistent with the statutory requirements of the 1995 Act. Consequently, the Court directed that the statutory benefits of reservation must be extended to all identified posts in Prasar Bharati, regardless of the mode of recruitment.
