The Supreme Court upheld the Kerala High Court's decision affirming the trial court's ruling that the plaintiff's suit was barred by limitation under Article 55 and Article 113 of the Limitation Act, 1963. The Court clarified that the limitation period for filing a suit for breach of contract begins when the contract is broken, which in this case was from the date of default in payment on 20th May, 1984. The suit filed on 25th May, 1988 was deemed time-barred as it exceeded the three-year limitation period.
