Judgment text excerpt

The Supreme Court held that the High Court erred in refusing to consider additional documents presented by the appellant regarding back wages for the period from March 1996 to September 1997 and December 2001 to October 2002. The Court emphasized that the High Court, under Article 226/227, should not interfere with the Industrial Tribunal's award unless it was wholly perverse. The Court restored the Industrial Court's order and directed the State to pay the awarded salary within three months, failing which interest would accrue at 12%.
