Judgment text excerpt

The Supreme Court held that the workmen of Narendra & Company are entitled to 50% back wages until January 1999, despite the Labour Court's earlier award limiting back wages to January 1995. The Court found that the Division Bench of the High Court erred in extending the back wages without sufficient evidence to prove the industry was closed since January 1995. The Court emphasized that findings of fact by the Single Judge should not be disturbed unless proven perverse, thereby upholding the Single Judge's decision regarding the closure of the industry and the entitlement of the workmen to retrenchment compensation and gratuity.
