Judgment text excerpt

The Supreme Court upheld the decision of the National Consumer Disputes Redressal Commission, affirming that the appellant, having accepted a refund of 10% of the plot cost, ceased to be a consumer under the Consumer Protection Act, 1986. The Court reiterated that once a consumer accepts a refund, they forfeit their right to seek possession of the property. The appeal was dismissed, confirming the orders of the lower commissions which ruled that the appellant had no locus standi to claim possession of the plot.
