The Supreme Court held that the High Court erred in reducing the compensation awarded under the Employees' Compensation Act, 1923, specifically under Section 4, which mandates compensation for death arising out of and in the course of employment. The Court emphasized that the deceased was indeed in the course of employment at the time of the accident, and thus the original compensation amount of Rs.10,75,253/- should be reinstated. The appeal was allowed, restoring the higher compensation amount and the penalty for delay in payment was also upheld.
