Judgment text excerpt

The Supreme Court upheld the decision of the National Consumer Disputes Redressal Commission (NCDRC) which dismissed the complaints filed under Section 23 of the Consumer Protection Act, 1986. The Court found that the appellants had not established a contractual relationship with the respondent American Consolidation Services Ltd. and that the liability for the goods rested with the carrier as per the bailment agreement. The Court partially allowed the complaints against the third respondent, awarding damages to the appellants, thus affirming the NCDRC's findings in part and reversing them in part.
